This manual contains analysis and explanation of criminal rules of procedure, including relevant case law which impacts interpretation or application of those rules. Other material, including practical and ethical considerations, gives attorneys guidance on issues that could impact the trail process.

Pattern jury instructions lay out the elements of crimes and burdens of proof in simple, straightforward model language, and can therefore be an invaluable resource for preparing complaints, defenses, and courtroom arguments.

This resource is primarily comprised of forms which can be adapted for many criminal trial situations. Forms are organized according to the chronology of the criminal case, and were either issued by the Administrative Office of the Courts or written by experienced attorneys. Other materials include attorney checklists and a few explanatory notes.

Smith, Jessica, North Carolina Crimes: a Guidebook to the Elements of Crime. Chapel Hill, NC : UNC School of Government, 2012. [KFN7961 .N61 2012]

This commonly-used resource lays out the elements of crimes, and provides both the statutory language defining the crime and major case law interpreting the statute.

Markham, James M. & Denning, Shea Riggsbee, North Carolina Sentencing Handbook with Felony, Misdemeanor, and DWI Sentencing Grids. Chapel Hill, NC: UNC School of Government, 2018. [KFN 7983.2 .Z9 M37 2018]

This short resource offers a guide to sentencing in North Carolina with primary law citations. Also included are grids colored for the date range of the offense, accounting for changes in law. Additional issues in sentencing are covered such as, the sex offender registry, multiple convictions, and probation.

This resource goes through the North Carolina statutes covering crimes and motor vehicle offenses in numerical order giving a brief description of the offense and its punishment classification. Throughout the chart are footnotes giving more detail or clarification to the offenses or punishments. Finally, there are three appendices to this resource covering the Crimes Victim's Rights Act, sex offender registry, and conviction-based driver's license revocations.  

Farb, Robert L., Arrest, Search, and Investigation in North Carolina. 6th ed. Chapel Hill, NC: UNC School of Government, 2021. [KFN7976 .F37 2021]

This resource covers North Carolina criminal law from arrests and investigative stops to rules of evidence in criminal cases, breaking each down in great detail. After each chapter, cross-referenced from within the chapter, is an appendix of relevant case summaries. Each chapter also comes heavily cited to primary law.

In this resource, each chapter covers a motion for a particular end, like suppressing evidence. The chapters begin with an in-depth explanation of the law surrounding the motion with citations and continues with sample motions. Some other included motions are: obtaining expert assistance, joinder and severance, and bail and pretrial release.

This exhaustive treatise offers practical guidance through various aspects of evidence. It includes explanations of doctrine and summary list of elements for topics ranging from competency of witnesses, to the hearsay rule, to credibility. It also includes sample motions and examples of how an exchange might go between counsel and a witness or the court.

This quick reference guide was designed to be a trial notebook. It offers brief explanations on criminal topics relevant in court and is organized in alphabetical order. Some sample topics covered are: Foundation Questions, Unintended Consequences, and Legal Motions.
